By downloading, accessing, or using the Nymly mobile application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Description of Service

Nymly is a platform that enables users to:

• Connect and chat with strangers anonymously
• Build friendships through our friend system
• Share text messages, images, and videos
• Communicate in real-time through secure messaging

3. Eligibility

You must be at least 13 years old to use Nymly. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws
• You have not been previously banned from the Service

4. Account and Registration

4.1 Anonymous Accounts

Nymly allows you to create an account without providing personal information such as email or phone number. You only need to provide:

• A nickname (which can be changed)
• Age range
• Gender (optional)
• Avatar or emoji selection

4.2 Account Security

While your account is anonymous, you are responsible for:

• Maintaining the security of your device
• Any activity that occurs under your account
• Not sharing your device with others who might misuse your account

5. User Conduct and Prohibited Activities

5.1 You Agree NOT To:

• Harassment: Harass, bully, threaten, or intimidate other users
• Hate Speech: Post content that promotes hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other characteristics
• Sexual Content: Share sexually explicit content, including but not limited to nudity, pornography, or sexual solicitation
• Minors: Attempt to contact, groom, or solicit minors
• Violence: Promote, encourage, or glorify violence or self-harm
• Spam: Send unsolicited advertising, promotional materials, or spam
• Illegal Activities: Use the Service for any illegal purpose or to violate any laws
• Impersonation: Impersonate others or misrepresent your affiliation with any person or entity
• Malware: Upload viruses, malware, or any malicious code
• System Abuse: Attempt to hack, reverse engineer, or compromise the Service
• Data Scraping: Use automated tools to collect data from the Service

5.2 Content Moderation

We employ automated and manual moderation to enforce these rules. We reserve the right to:

• Remove any content that violates these Terms
• Suspend or terminate accounts that violate these Terms
• Report illegal activity to law enforcement

• End Chat: You can end any conversation at any time

9. Disclaimers and Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Warranties regarding the accuracy or reliability of content

9.2 User Interactions

We are not responsible for:

• The conduct of other users
• Content shared by other users
• Any interactions or disputes between users
• Any damages resulting from your use of the Service

9.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

You agree to indemnify, defend, and hold harmless Nymly, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity

11. Termination

11.1 By You

You may stop using the Service at any time. You can delete your account through the app settings, which will permanently remove your data.

11.2 By Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Suspected illegal activity
• Extended periods of inactivity
• Requests by law enforcement or government agencies
• Technical or security issues

11.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• Your data will be deleted in accordance with our Privacy Policy
• Provisions that should survive termination will remain in effect
